We, the undersigned 738 organizations, agencies, and institutions dedicated to supporting victims and holding offenders accountable, urge the Senate to honor Crime Victims’ Rights Week by acting to swiftly pass the Crime Victims Fund Stabilization Act (CVFSA), which the House passed by a unanimous voice vote in January. This critical, bipartisan legislation temporarily bolsters the Crime Victims Fund (CVF), which is the primary source of funding for victim services across the country, including services for victims of child abuse (including child sexual abuse), sexual assault, domestic and dating violence, human trafficking, stalking, elder abuse, drunk driving, community violence, and other crimes. It also funds victim witness specialists in prosecutors’ offices and law enforcement agencies, ensuring victims receive guidance through the justice process, assistance preparing impact statements, and support as they testify. This assistance not only increases conviction rates, but most importantly helps victims find their voice and begin the healing process.
In 1984, President Reagan signed the Victims of Crime Act (VOCA) into law. VOCA established the CVF, which was funded by monetary penalties associated with federal criminal convictions—not taxpayer money. In addition to funding victim services, VOCA matches a portion of state victim compensation funds. The bulk of the annual disbursement is distributed through a formula grant, funding victim services and victim witness specialists across the country.
Until 2000, deposits collected every fiscal year were disbursed to the field in their entirety the following fiscal year. In 2000, to reduce the impact of annual fluctuations in deposits on grant recipients, Congress imposed an annual cap, giving Appropriators discretion over the annual release. This provided stability to the victim service field and allowed long-term planning to ensure consistent and efficient services for victims.
However, dwindling annual deposits across both Democratic and Republican administrations, have compromised the balance of the CVF and jeopardized victim service providers’ and prosecutors’ offices’ ability to provide consistent support for victims. Annual deposits dropped from an average of approximately $2.9 billion from 2010 to 2017 to approximately $1.3 billion between 2018 and 2025 (including the Binance and British American tobacco settlements, which are under litigation and not available for obligation). Due to the pre-existing CVF balance, Appropriators were able to hold annual VOCA funding steady through FY2023, but the CVF is nearly depleted, and we have returned to the state Congress sought to prevent in 2000—substantial fluctuations that grant recipients are unable to absorb. A 40% cut to the annual VOCA cap between 2022 and 2024 devastated the victim services infrastructure, despite mitigation in many states through the appropriation of unobligated American Rescue Act plan funds. Organizations were forced to cut life-saving services, lay off staff, and in some cases—particularly in rural communities—close entirely. While funding has been partially, but not fully, restored, programs have been unable to fully recover from the catastrophic cuts.
The VOCA Fix to Sustain the Crime Victims Fund, which became law in 2021, partially addressed the balance shortfall by depositing monetary penalties from deferred and non-prosecution agreements into the CVF. At the time, all indications (including the CBO score) pointed to an increase in settlements as the source of declining deposits. While the VOCA Fix increased deposits by an average of $504.8 million annually (including the Binance and British American tobacco settlements), the increase has been insufficient to restore stability to the CVF.
Congress and VOCA stakeholders are committed to identifying the cause of diminished deposits so it can be addressed once and for all. However, we need a stop-gap measure to ensure victims can access critical services while Congress and the Department of Justice determine why deposits have dropped so dramatically and develop a long-term solution. To address this need while the investigation of the root causes is ongoing, members of Congress identified another source of non-taxpayer funding collected from bad actors: the False Claims Act (FCA).
The FCA allows the federal government to recover up to triple damages from individuals and entities that defraud the federal government, stealing from the American people. The Crime Victims Fund Stabilization Act deposits unobligated FCA receipts into the CVF through FY2029, specifically stipulating that qui tam whistleblowers are remunerated and the federal government is reimbursed first, and only the remaining receipts are deposited into the CVF. The House-passed bill also directs the Department of Justice’s Office of Inspector General to conduct a comprehensive audit of the Crime Victims Fund to determine the cause or causes of the deposit shortfall and to provide recommendations to Congress to restore stability to the CVF–vital information that should enable Congress to enact a more permanent solution.
The bipartisan House bill, sponsored by an overwhelming 75% of members, passed the House by a unanimous voice vote and was referred to the Senate in mid-January. We call on the Senate to stand up for victims and survivors rather than standing by, and we urge you to bring the Crime Victims Fund Stabilization Act immediately to the floor for a vote. Every day the Senate delays is a day the CVF is not being replenished. Your constituents are counting on you to ensure they have access to victim services in their hour of need.
